Unpad Expert: Early Marriage Figures Rise During Pandemic
West Java is one of the provinces contributing the highest number of underage marriages in Indonesia based on data from the National Planning and Development Agency in 2020.
A lecturer at the Department of Civil Law, Faculty of Law, Padjadjaran University, Susilowati Suparto, said that the increase in the number of early marriages during the Covid-19 pandemic during one of them was suspected due to economic problems.
"Workers who are also parents often take alternative shortcuts by marrying their children at an early age because they are considered able to ease the burden on the family," said Susilowati in the Webinar "Marriage Dispensation during the Covid-19 Pandemic Period: Challenges to Efforts to Minimize Child Marriage in Indonesia "Which was held by Unpad Law Faculty, Friday (3/7/2020), as reported by the Unpad page.
The lack of parental supervision related to school closure policies and the application of learning at home is also one of the triggers for the rise of early marriage.
Susilowati said, learning activities at home resulted in teenagers having the freedom to socialize in the surrounding environment. This happens when parental supervision of their children is very weak.
"It is unavoidable that promiscuity will result in pregnancy out of wedlock and cause the dispensation rate to increase during this pandemic," he added.
The court should not allow marriage dispensation permits
The practice of early marriage is found to continue to flourish even though the government has revised the minimum age limit for marriage in Indonesia to 19 years through Law No. 19 of 2019.
In addition, there are rules that stipulate that deviations from the minimum age limit in marriage can only be applied for dispensation to the court.
But in fact, this regulation has not suppressed the practice of early marriage in Indonesia. Dispensation to court is increasing.
Unpad Faculty of Law lecturer Sonny Dewi Judiasih explained, the practice of marriage in general is vulnerable to occur in rural women who come from poor families and low levels of education.
Getting pregnant first in your teens is a factor in early marriage
A number of factors that influence the practice of early marriage include geographical factors, the incidence of pregnancy out of wedlock, the strong influence of customs and religion, to the lack of access to reproductive health information.
Supposedly, suggested Sonny, the court should not simplify the permit for marriage dispensation. Facts on the ground, almost 90 percent of requests for marriage dispensation were granted by the judge.
This makes Indonesia often survive in the ranks of countries with the highest early marriage rates in the world.
Sonny explained, the consideration of trying a marriage dispensation petition must refer to the Supreme Court Regulation Number 5 of 2019.
"Whether these reasons are urgent or can be postponed, and consider the protection and best interests of children in legislation and unwritten laws in the form of legal values, local wisdom, and a sense of justice that lives in the community," he concluded.
